1. Who we are

This website, alcamielements.com, is operated by Alcami Elements ("Alcami", "we", "us" or "our"), 5750 Avenue Andover, Mont-Royal, Quebec H4T 1H4, Canada. These Terms of Service ("Terms") apply when you visit the site, create an account, subscribe or buy from us. By using the site or placing an order, you agree to these Terms and to the policies they refer to: our Privacy Policy, Refund Policy, Shipping Policy and Cancellation Policy. If you do not agree, please do not use the site.

2. Eligibility and your account

You must be at least the age of majority where you live to place an order. If you create an account, keep your details accurate and your login secure. You are responsible for activity under your account.

3. Our products and health information

Our products are foods and dietary supplements. They are not intended to diagnose, treat, cure or prevent any disease, and statements on this site have not been evaluated by the U.S. Food and Drug Administration. The content on this site, including articles, recipes and customer reviews, is general information and not medical advice. Please talk to a qualified health professional before using our products if you are pregnant or nursing, take medication, or have a medical condition. Customer reviews describe individual experiences, and results vary.

4. Product information and pricing

We work to describe our products, ingredients, prices and availability accurately. Colours and images may differ slightly from the product you receive. If we find an error in a price or description, we will correct it, and if your order has not shipped we may cancel it and refund you in full. Prices are shown in the currency you select; converted prices are estimates and your bank may charge its own fees. Taxes and shipping are shown at checkout before you pay.

5. Orders

Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel an order, or limit quantities, for example in case of suspected fraud, resale or an obvious error. If we cancel an order after you have paid, we refund you in full.

6. Subscriptions (Rituals)

When you choose a subscription ("Ritual"), you authorize us to charge your payment method for your first order and then automatically at the frequency shown when you subscribed (for example every 30 days), at the subscription price in effect at that time plus any applicable taxes and shipping, until you cancel.

You can pause, skip, change or cancel your subscription at any time from your account or by emailing team@alcamielements.com. There is no minimum number of orders. To avoid the next charge, cancel before your next billing date. Cancelling stops future renewals and does not refund orders that have already been processed. If we change the price of your subscription, we will tell you by email before the new price applies, and you can cancel before then. See our Cancellation Policy for details.

7. Free gifts, offers and discount codes

Free gifts such as the Welcome Kit are limited to one per customer unless an offer says otherwise, and are available while supplies last. Promotions and discount codes are subject to the conditions shown with them, have no cash value and cannot be combined unless stated. We may change or end an offer at any time; this does not affect orders already placed.

8. Shipping, returns and refunds

Processing and delivery times and shipping costs are described in our Shipping Policy. Returns, refunds and exchanges are covered by our Refund Policy.

9. Gift cards

Gift cards can be used toward eligible purchases on alcamielements.com. They cannot be exchanged for cash, except where the law requires it. Please keep your gift card code safe; we cannot replace a code that someone else has used.

10. Reviews and content you share

If you post or send us a review, photo, video or other content, you confirm that it reflects your own honest experience and that you have the right to share it. You give us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in connection with our business, including on our website, emails and social media, with your name or initials as you provided them. We may remove content that is unlawful, offensive, misleading or unrelated to our products.

11. Emails and text messages

You can unsubscribe from marketing emails at any time using the link in any email. If you sign up for text messages, you also agree to our Messaging Terms and Messaging Privacy Policy. Consent to texts is not a condition of purchase, message frequency varies, message and data rates may apply, and you can reply STOP to cancel at any time.

12. Affiliate and referral programs

Our affiliate and referral programs have their own terms, which apply in addition to these Terms when you join them.

13. Using the site

Please do not use the site for any unlawful purpose; interfere with its security or operation; upload viruses or malicious code; collect other users' information; scrape or copy the site by automated means; buy products for unauthorized resale; or misuse discount codes, gifts or referral rewards. We may suspend or close accounts that do.

14. Intellectual property

The Alcami name, logos, product names, photos, videos, text and design on this site belong to us or our licensors and are protected by law. You may not copy, reproduce or use them for commercial purposes without our written permission.

15. Third-party links and services

The site may link to or use services run by third parties, such as payment providers, review platforms and social media. We are not responsible for their content or practices, and their own terms and privacy policies apply when you use them.

16. Disclaimers and limitation of liability

To the extent permitted by law, the site and its content are provided "as is", and we do not guarantee that the site will always be available or free of errors. To the extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from your use of the site or our products, and our total liability for any claim relating to an order is limited to the amount you paid for that order.

Nothing in these Terms excludes or limits any rights you have under consumer protection laws that cannot be excluded or limited, including the Quebec Consumer Protection Act, or our liability where the law does not allow it to be limited.

17. Governing law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. If you are a consumer, you also keep the protection of the mandatory consumer laws of the place where you live, and you may bring a claim before the courts where you live where those laws allow it.

18. Changes to these Terms

We may update these Terms from time to time. The version posted on this page, with its "Last updated" date, applies to orders placed after that date. Orders already placed remain under the Terms in effect when you placed them.
